By downloading, installing, or using any application published by Sparkbyt Digital ("we", "our", or "us"), or by accessing this website (sparkbytdigital.com), you agree to be bound by these Terms of Use. If you do not agree, please do not use our apps or this website.
License to Use Our Apps
We grant you a limited, non-exclusive, non-transferable, revocable licence to use our apps on any Apple device that you own or control, as permitted by the Apple App Store Terms of Service.
You may not:
- Copy, modify, or distribute the app or any part of it.
- Reverse engineer, decompile, or attempt to extract the source code.
- Use the app for any unlawful purpose or in violation of any applicable laws.
- Remove, alter, or obscure any proprietary notices within the app.
App Store Terms
Our apps are distributed through Apple's App Store. Your use of our apps is also subject to Apple's Standard End User Licence Agreement (EULA), which is incorporated into these Terms by reference. Apple is not responsible for our apps or their content.
In-App Purchases
Some apps may offer optional paid features through Apple's in-app purchase system. All purchases are final and subject to Apple's refund policies. We do not process payments directly and have no access to your payment information.
Where a free tier is available, we will not remove it or degrade its functionality to force an upgrade.
Your Data
All data you create within our apps is stored locally on your device. We have no access to this data. You are solely responsible for maintaining backups of your data. We are not liable for any data loss resulting from device failure, accidental deletion, app removal, or any other cause.
Disclaimer of Warranties
Our apps and this website are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our apps will be error-free, uninterrupted, or free of bugs. Use of our apps is at your own risk.
Our apps are intended as personal productivity tools. They are not a substitute for professional financial, medical, or other licensed advice.
Limitation of Liability
To the fullest extent permitted by applicable law, Sparkbyt Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our apps or website. Our total liability to you for any claim arising from these Terms or our apps shall not exceed the amount you paid for the app in question in the twelve months preceding the claim.
Intellectual Property
All content, design, code, logos, and trademarks associated with Sparkbyt Digital and our apps are owned by us or licensed to us. Nothing in these Terms grants you any right to use our intellectual property except as expressly set out here.
Changes to These Terms
We may update these Terms from time to time. We will update the "Last updated" date at the top of this page when we do. Continued use of our apps after changes are posted constitutes your acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of Singapore. Any disputes arising from these Terms or your use of our apps shall be subject to the exclusive jurisdiction of the courts of Singapore.
